How much is my case worth?
This is the most frequently asked question by clients about
personal injury claims. After the initial interview, most
experienced personal injury lawyers have a general idea of
the range of values for the client's case. However, the
final determination of the actual value of the case depends
on many factors which are most likely not known by the lawyer
until after the lawyer has had an opportunity to develop the
case. For example, the value of a case depends not only the
nature and extent of injuries, but also on the factual
circumstances of the accident or incident giving rise to
those injuries. A serious injury may have less value because
liability issues are unclear. Fruther, the value of a claim
may also be reduced because of comparative negligence on the
person bringing the claim. Experienced personal injury
lawyers will thus not state their impressions about the
value of the case because those impressions will continue to
evolve as the case develops. Instead, they advise and make
recommendations to the client as to whether a settlement
offer is fair under the unique circumstances of the client's
case and whether to accept the settlement offer or take
the case to trial.
